THE COUTURE ARCHIVE — BOUTIQUE CONSIGNMENT AGREEMENT By submitting this application, the boutique ("Partner") agrees to the following terms with The Couture Archive ("Platform"): 1. CONSIGNMENT. Partner consigns designer evening gowns and wedding dresses to the Platform for listing and sale to customers. Title remains with the Partner until an item sells; the Platform lists, markets, and facilitates the sale. 2. CONDITION — NEW SAMPLES ONLY. Partner represents and warrants that every item listed is a NEW boutique sample or past-season piece that has NEVER been rented or worn by a consumer. Items that are altered beyond sample condition, soiled, damaged, or previously worn are prohibited. 3. INSPECTION, RETURN & HANDLING FEE. The Platform may inspect any item. If an item shows signs of having been worn or is otherwise misrepresented, the Platform will return the item to the Partner AT THE PARTNER'S EXPENSE (all shipping and return costs) and charge the Partner a handling fee of $50 per item. This may be deducted from the Partner's balance. 4. COMMISSION & PAYOUT. The Platform retains its stated commission on each sale; the remainder accrues to the Partner's payout balance. 5. FULFILLMENT. Partner confirms and ships sold items promptly with valid tracking, and provides accurate descriptions, measurements/size, and honest condition disclosures. 6. AUTHENTICITY & LEGALITY. Partner warrants that all items are authentic designer goods that the Partner has the legal right to sell, and that the Partner holds a valid resale certificate and tax registration (EIN) as provided. 7. TERMINATION. Either party may end this arrangement with notice; the Partner remains responsible for fulfilling any in-progress orders. By typing their name as an electronic signature below, the Partner acknowledges they have read, understood, and agreed to this Agreement.
